Adoption
Legislation allows for the adoption of a child at any time up to their 18th birthday. The age gap is therefore inconsistent with other legislation impacting upon when a child becomes an Adult.
Petitions for Adoption can be presented by a relevant couple or by sole individuals. Step-parent adoptions are common but such applications do present themselves in a number of difference circumstances.
Most applications are undertaken in the Sheriff Court. Where there are particular complexities, such as international dimensions, the Court of Session in Edinburgh is the appropriate Court.
Biological parents who have retained any of their Parental Responsibilities and Rights are entitled to oppose an Adoption Order. Adoption Orders can be made subject to particular terms and conditions.
